International Use & Jurisdiction-Specific Terms

We sell and ship products to customers in the United States and internationally, including the European Economic Area (EEA), United Kingdom (UK), Switzerland, Canada, and Australia.

For U.S. Customers:

Your use of the Site is governed by U.S. law, and you agree to the jurisdiction outlined in Section 11 below.

For Customers in Europe (EEA, UK, Switzerland):

We strive to display product descriptions, photography, dimensions, and pricing as accurately as possible. However, we do not guarantee that your device's display will be error-free. All products are subject to availability and may be changed or discontinued without notice.

Orders & Payments

All orders placed through our Site are subject to our acceptance. You will receive an order confirmation email after submitting your order, but this confirmation does not constitute acceptance of your order. We reserve the right to cancel or refuse any order for any reason at any time, including due to product availability, errors in pricing or product information, or suspected fraud.

We reserve the right to change prices for products and services at any time without notice. While we strive to ensure accurate pricing, errors may occur. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information so we can complete your transactions and contact you as needed.

Payments are processed through trusted third-party payment processors (see Payment Processing & Security).

Payment Processing & Security

We use trusted third-party payment processors—such as Shopify Payments, PayPal, and others—to process transactions made through our Site. These providers are independently responsible for securely collecting, transmitting, and storing your payment information.

We do not have access to your full credit card number, nor do we store or control payment data on our servers. Your use of third-party payment services is governed by the privacy policies and terms of those platforms.

While we implement reasonable security measures to protect your personal data, Haverhill is not liable for any losses, damages, or unauthorized access arising from security breaches or compliance failures by third-party payment processors, including PCI DSS violations.

Shipping, Returns & Exchanges

We strive to process and ship all orders promptly. Shipping costs and estimated delivery timelines are displayed at checkout and may vary based on your location and chosen delivery method.

We primarily ship via trusted third-party carriers such as UPS and FedEx, though we reserve the right to use other providers when appropriate. Risk of loss and title for products purchased from us pass to you upon our delivery to the shipping carrier.

For U.S. Customers:

Applicable state, county, or municipal sales taxes will be added at checkout where required by law. You are solely responsible for any additional use taxes or other fees that may be imposed by your state or local jurisdiction after purchase.

For International Customers (Incl. Canada, Australia, and Europe):

You may be subject to import duties, VAT, GST, customs clearance fees, and other taxes imposed by your local government. These fees are not included in our product prices or shipping charges and are your responsibility. We recommend checking with your country’s customs office for more information on any applicable fees before placing an order.

Shipping times provided are estimates and are not guaranteed. Delays caused by carriers, customs inspections, or other unforeseen circumstances are outside of our control.

Intellectual Property

All content on this Site—including but not limited to product designs, images, text, graphics, logos, videos, and layout—is the intellectual property of Haverhill or its licensors, and is protected under U.S. and international copyright and trademark laws. You may not reproduce, distribute, modify, display, or create derivative works from any materials on the Site without our express written consent.

User Submissions

If you submit reviews, photos, or other content (“User Content”), you grant Haverhill a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, display, and distribute such content in any media. You represent that you have the rights to grant this license and that your content does not infringe the rights of any third party.

 Disclaimer of Warranties

This Site and all content and services are provided “as is” and “as available,” without warranties of any kind. We do not guarantee that the Site will be uninterrupted or error-free. To the fullest extent allowed by law, we disclaim all implied warranties, including those of merchantability or fitness for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, Haverhill shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Site or purchase of products. Our total liability shall not exceed the total amount you paid for the relevant product.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of the State of Rhode Island, without regard to conflict of law principles. You agree that any dispute arising from or related to these Terms shall be brought exclusively in the state or federal courts located in Rhode Island.

If you are a customer in the EEA or UK, you may also have the right to bring disputes in your local jurisdiction under applicable consumer protection laws.

California Residents – Your Rights

If you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA) and California Civil Code Section 1798.83 ("Shine the Light" law):

• You may request access to or deletion of your personal information.

• You may opt out of the sale or sharing of your personal information.

• You may request a list of third parties to whom we have disclosed personal data for direct marketing purposes in the past calendar year.

We do not discriminate against users for exercising their privacy rights.
